Mutuum is a non-custodial platform. We do not hold, control, or have access to your cryptocurrency assets or private keys. You maintain complete custody and control of your funds at all times. We cannot recover lost funds, reverse transactions, or access your wallet without your private keys.
4. User Accounts and Wallet Connection
4.1 Wallet Connection
To access trading features, you must connect a compatible cryptocurrency wallet (such as MetaMask, WalletConnect, or others supported by our Platform). By connecting your wallet:
- You represent that you own and control the connected wallet
- You acknowledge that we do not have access to your private keys or seed phrases
- You accept responsibility for all transactions initiated from your wallet

5.2 Fees and Costs
Using Mutuum involves various fees:
- Trading Fees: A percentage fee (typically 0.3%) charged on each swap transaction
- Network Fees: Blockchain gas fees required to execute transactions (paid to network validators, not Mutuum)
- Slippage: Price impact from your trade affecting the final exchange rate
- Additional Fees: Potential fees for specific features, services, or premium tiers
Fee structures are transparent and displayed before transaction confirmation. We reserve the right to modify fee structures with reasonable notice.
5.3 Transaction Risks
You acknowledge and accept the following risks:
- Price Volatility: Cryptocurrency prices can fluctuate significantly, resulting in substantial gains or losses
- Slippage Risk: Executed prices may differ from quoted prices due to market movements
- Liquidity Risk: Insufficient liquidity may prevent order execution or cause unfavorable pricing

6. Liquidity Provision and Staking
6.1 Liquidity Pools
When you provide liquidity to Mutuum pools:
- You deposit equal values of two tokens into a liquidity pool
- You receive liquidity provider (LP) tokens representing your share
- You earn a portion of trading fees generated by the pool
- You accept the risk of impermanent loss due to price changes
- You can withdraw your liquidity at any time by burning your LP tokens
6.2 Staking Programs
Staking involves locking tokens for specified periods in exchange for rewards:
- Rewards are not guaranteed and depend on various factors
- Staked tokens may have withdrawal restrictions or lock-up periods
- Reward rates may change based on platform performance and governance decisions
- Early withdrawal may result in penalties or forfeited rewards
6.3 No Investment Guarantees
Liquidity provision and staking do not constitute investments in Mutuum. Returns are variable, not guaranteed, and you may lose some or all of your deposited funds. Past performance does not indicate future results.
7. Intellectual Property Rights
7.1 Platform Ownership
All content, features, functionality, and materials on the Mutuum Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (collectively, the "Content"), are the exclusive property of Mutuum or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 Limited License

- Violating any applicable laws, regulations, or ordinances
- Infringing on intellectual property rights of Mutuum or third parties
8.2 Fraudulent or Manipulative Behavior

- Providing false, misleading, or inaccurate information
- Exploiting bugs, vulnerabilities, or errors in the Platform
8.3 Technical Interference
- Interfering with or disrupting the Platform's operation or infrastructure
- Introducing viruses, malware, or malicious code
- Attempting unauthorized access to Platform systems or user accounts
- Using automated systems (bots, scrapers) without authorization
- Overloading or attacking Platform infrastructure (DDoS attacks)
8.4 Misuse of Services
- Circumventing geographic, technical, or account restrictions
- Using the Platform from prohibited jurisdictions via VPNs or proxies

9. Disclaimers and Limitation of Liability

- ACCURACY, COMPLETENESS, OR RELIABILITY OF PLATFORM CONTENT
- AVAILABILITY, UPTIME, OR ERROR-FREE OPERATION
- SECURITY OR FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS
- TRANSACTION OUTCOMES OR INVESTMENT RESULTS
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Mutuum, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- TRADING LOSSES OR INVESTMENT LOSSES OF ANY KIND
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
- DAMAGES FROM PLATFORM INTERRUPTIONS, ERRORS, OR DELAYS
- DAMAGES FROM SMART CONTRACT FAILURES OR VULNERABILITIES
- DAMAGES FROM THIRD-PARTY ACTIONS OR BLOCKCHAIN NETWORK ISSUES
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) £100 OR (B) THE AMOUNT OF FEES YOU PAID TO Mutuum IN THE 12 MONTHS PRECEDING THE CLAIM.
9.3 Risk Acknowledgment
You explicitly acknowledge and accept that:

- You may lose some or all of your invested capital
- Decentralized finance is experimental and subject to significant risks
- Smart contracts may contain bugs or vulnerabilities despite security audits
- Blockchain transactions are irreversible and cannot be refunded

10. Indemnification
You agree to indemnify, defend, and hold harmless Mutuum, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, partners, licensors, and contractors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

- Your violation of these Terms or any applicable laws
- Your violation of any rights of third parties
- Your trading activities and investment decisions

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Mutuum. You have no authority to bind Mutuum or make representations on our behalf.
13.8 Third-Party Beneficiaries
These Terms do not confer any third-party beneficiary rights. Only you and Mutuum may enforce these Terms.
13.9 Language
These Terms are drafted in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.
