  • MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • ACCURACY, COMPLETENESS, OR RELIABILITY OF PLATFORM CONTENT
  • AVAILABILITY, UPTIME, OR ERROR-FREE OPERATION
  • SECURITY OR FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS
  • TRANSACTION OUTCOMES OR INVESTMENT RESULTS

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Mutuum, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • TRADING LOSSES OR INVESTMENT LOSSES OF ANY KIND
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
  • DAMAGES FROM PLATFORM INTERRUPTIONS, ERRORS, OR DELAYS
  • DAMAGES FROM SMART CONTRACT FAILURES OR VULNERABILITIES
  • DAMAGES FROM THIRD-PARTY ACTIONS OR BLOCKCHAIN NETWORK ISSUES

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) £100 OR (B) THE AMOUNT OF FEES YOU PAID TO Mutuum IN THE 12 MONTHS PRECEDING THE CLAIM.

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Mutuum. You have no authority to bind Mutuum or make representations on our behalf.

These Terms do not confer any third-party beneficiary rights. Only you and Mutuum may enforce these Terms.

These Terms are drafted in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.
